Terms of Use.

These terms apply to the website and to all Influx Games apps, including online features such as multiplayer, friend lists and leaderboards (together the “Services”).

You download our games from Apple’s App Store or Google Play. Download, payment and refunds are additionally subject to the terms of the respective store, and apps from the App Store are also subject to Apple’s Licensed Application End User License Agreement. Apple and Google are not parties to these terms and are not responsible for our games or their support.

You can download and play our games for free. We offer some content or features as in-app purchases, and the games are also funded by advertising.

We keep developing our games. We may change, extend or discontinue features as long as this is reasonable for you. There is no entitlement to specific features or to constant availability of the online services. Maintenance and outages may cause interruptions.

You need a player account for online multiplayer, friends and leaderboards. The following applies:

• Your details must be accurate, and your account is for you only.
• Keep your login details secret. If you notice any misuse, please let us know immediately.
• Your player name must not infringe the rights of others, must not be offensive, discriminatory or obscene and must not suggest that you are part of Influx Games.

You can have your account deleted at any time: by email to hello@influxmediahouse.com or, where available, directly in the game.

If you are not yet of legal age, you need the consent of your parents or other legal guardians for in-app purchases. You may create a player account yourself from the age of 14; before that, only with their consent.

So that everyone has fun, fair play applies. In particular, the following is not allowed:

• cheats, bots, hacks or other programs that give you an unfair advantage,
• exploiting bugs instead of reporting them to us,
• manipulating game results or leaderboards, including via multiple accounts or arranged matches,
• insulting, harassing or threatening other players,
• decompiling, modifying or redistributing our games, unless expressly permitted by law,
• any commercial use without our consent.

In case of violations, we may remove results from leaderboards, change player names and suspend accounts temporarily or permanently. We take into account how serious the violation is and tell you the reasons.

Have you noticed a player name or other content that is illegal or violates these terms? Please report it to hello@influxmediahouse.com, ideally with the game, the player name and a short explanation. We review every report promptly.

• Purchases in our games are processed via the App Store or Google Play. The prices shown there, including VAT, and the payment and refund rules of the respective store apply.
• Purchased content, such as virtual items or additional features, is tied to your store or player account. You may use it within the game, but not transfer or sell it.
• Virtual items have no monetary value and cannot be exchanged for real money.
• Please request refunds directly from the store. Your statutory rights as a consumer, in particular the statutory warranty, remain unaffected.

Our games show ads so that we can offer them for free. The ads come from advertising partners; the respective advertisers are responsible for their content. You can find out which data is processed and what choices you have in the Privacy Policy.

You can subscribe to push notifications about new games on the website. This is voluntary and free, and you can turn them off at any time. There is no entitlement to a particular number or frequency of messages.

All rights to our games, trademarks, logos, texts, graphics, videos and sounds belong to Influx MediaHouse GmbH or our licensors. We allow you to use the Services for private, non-commercial purposes. This permission is not transferable and ends if your account is suspended because of a violation. All other rights remain with us.

We are liable without limitation for intent and gross negligence and for personal injury. In cases of slight negligence, we are only liable for personal injury. This also applies to our employees and agents.

We do our best to preserve game progress and leaderboards permanently, but cannot guarantee this in the event of technical problems.

Mandatory statutory rights, in particular as a consumer, remain unaffected.

We may update these terms, for example when we introduce new games or features or the legal situation changes. We will inform you of material changes in good time beforehand on the website or in the game. If you do not agree, you can stop using the Services and have your account deleted.

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-law rules of private international law. If you are a consumer, the mandatory consumer protection rules of the country where you live continue to apply.

For businesses, the competent court at the registered office of Influx MediaHouse GmbH has exclusive jurisdiction. For consumers, the statutory places of jurisdiction apply.
